PhilipMorris.ph: THE GREAT PM RAFFLE PROMOTION - MONTHLY GRAND RAFFLE and PM REWARDS Mechanics

I. General Terms and Conditions

1. The PhilipMorris.ph: THE GREAT PM RAFFLE PROMOTION - MONTHLY GRAND RAFFLE and PM REWARDS (together the “Promotion/s”) are open only to adult smokers 18 years old and above residing in the Philippines and verified members of the Philip Morris Adult Smoker Database (“Verified Members”).

   To be a Verified member, an adult smoker must register through either of the following channels:

   • Via www.PhilipMorris.ph. An adult smoker 18 years old and above must:

     1. Completely fill out the registration form and provide true and accurate information; and

     2. Successfully upload a valid Government Issued ID (“GIID”) as proof of age (subject to PMFTC call center verification)
        OR
        Successfully pass Access Control System (ACS) confirming that he/she is of legal age (18 years old and above).

   • Via direct consumer engagement. An adult smoker 18 years old and above will be subject to a face-to-face age verification by PMFTC third party promoters or brand hostesses and will be asked to present a valid GIID as proof of age should there be doubts via face-to-face age verification.

   Acceptable valid GIIDs as proof of age are: Passport, Alien Certificate of Registration, Driver’s License, Firearms License, NBI Clearance Card, Philhealth ID, Postal ID, PRC ID, SSS ID, TIN ID, Unified Multi-Purpose ID or Voter’s ID

2. The Promotion period is from MAY 7, 2021 to DECEMBER 31, 2021 (“Promotion Period”). PMFTC Inc. (“PMFTC”) has the sole discretion to shorten or extend the Promotion period if circumstances so warrant.

3. PMFTC reserves the right to modify, change, or revise the rules and mechanics of the Promotions.

4. PMFTC reserves the right to hold, suspend, disqualify, or block a Verified Member’s account or to disqualify and terminate his/her participation in the Promotions due to suspicious activity, fraud or any irregular or illegal activity.

5. PMFTC reserves the right to cancel, amend, or revoke these terms and conditions or any part of the mechanics without notice in the event of irregularities, fraudulent activity, cheating, a security breach, anticipated breach of any applicable law or regulation, or an event or disturbance outside of PMFTC’s control such as acts of God, civil or military events, catastrophes, technical issues/connectivity, epidemic, pandemic or war. Any changes to the terms and conditions or mechanics of the Promotions will be announced accordingly.

6. Joining the Promotions is not mandatory. Verified Members may choose not to participate in any of the Promotions.

7. Activities, promotion/s and/or campaigns presented in this website do not serve as a prompt or request, direct or indirect, for you to share any content through any social media channels. By participating in the Promotions, you agree not share on any social media channel, posts (image or text) or hashtags related to PMFTC brands and/or products, this activity, promotion and/or campaign created by us in any activity or event.

8. Confirmation notices and/or messages will be sent to the Verified Member’s email address and/or mobile number as registered in PhilipMorris.ph (“Website”). It is the responsibility of the Verified Member to update his/her personal details in the Website to ensure timely receipt of the confirmation notice or message. PMFTC shall not be liable for any failure to redeem or use any prize, and will not refund any deducted coins, due to non-receipt by the Verified Member of the confirmation notice or message, if sent to his/her registered email address or mobile number.

   1. To update personal details, Verified Member may contact the adult-restricted hotline 02-895-9999 (Metro Manila), 0917-7074999 (Globe), 0919-0704999 (Smart) or email to info@philipmorris.ph.

9. Issuance of rewards, raffle-related notifications, coins (as electronic rewards) and electronic or website- related activities are subject to possible delays or changes in program mechanics.

10. Government Warning: Cigarette Smoking is Dangerous to Your Health.

II.A MECHANICS: INPUTTING UNIQUE PACK CODES

1. A Verified Member may participate in THE GREAT PM PROMOTION by completing the registration process of www.PhilipMorris.ph and by entering a valid unique pack code that can be found inside participating Philip Morris products (“Participant”).

2. The case-sensitive, alphanumeric (mix of letters and numbers), unique pack code should be inputted in the designated field in www.PhilipMorris.ph and is subject to system validation before it is included in the electronic raffle draw.

3. The unique pack codes of the following Philip Morris products are valid for one-time use in PhilipMorris.ph

   1. Philip Morris Red

   2. Philip Morris Menthol 100’s

4. Only system validated unique pack codes of participating Philip Morris Products will be accepted in PhilipMorris.ph. Validation of unique pack codes is done automatically in www.PhilipMorris.ph

5. One (1) validated unique pack code is equivalent to three (3) electronic raffle entries valid for THE GREAT PM RAFFLE and 40 coins useable in THE GREAT PM INSTANT REWARDS promotion. Each unique pack code is valid for one time use only.

   1. Introductory Offer - For the first valid unique pack code inputted, a Verified Member will receive 100 coins and three (3) electronic raffle entries. This offer is only valid for the FIRST valid unique pack code inputted by a Verified Member in the Website. Succeeding valid unique pack code inputs will ONLY be awarded 40 coins and three (3) electronic raffle entries.

6. Each day (12:00AM to 11:59PM) until December 31, 2021, a Verified Member can enter up to three (3) valid unique pack codes to join MONTHLY GRAND RAFFLE.

7. PMFTC reserves the right to change the rewards (number of coins and raffle entries) earned per valid unique pack code inputted.

8. Unique pack codes used/inputted in other PMFTC promotions (Ex. Appwards, Marlboro.ph, etc.) are no longer valid and cannot be used in the Website.

9. Unique pack codes used/inputted in the Website are no longer valid and cannot be used in other PMFTC promotions (Ex. Appwards, Marlboro.ph, etc.)

II.B MECHANICS: PHILIPMORRIS.PH MONTHLY GRAND RAFFLE

1. An electronic raffle may be earned by inputting valid unique pack codes of participating Philip Morris products.

2. Monthly Draws:

   1. Each month there will be one (1) or five (5) winners of the Grand Prize. Number of winners is dependent on the corresponding prize as stated in the table below.

   2. There will be a total of 8 draws, and a total of 24 winners for the entire Promotion Period.

3. Winning Limits:

   1. A Participant can only win once during each raffle draw, subject to Promotion terms and conditions.

   2. Grand Prize Limit:

      • Each Participant can only win one Grand Prize throughout the entire Promotion Period.

      • Previous Grand Prize winner/s may still participate in THE GREAT PM INSTANT REWARDS to claim instant prizes via the rewards catalogue./p>

4. Electronic raffle entries of Participants who have not yet won or met the winning limits in THE GREAT PM RAFFLE will be included in the succeeding draws to give them an opportunity to win.

5. The eligible winners of THE GREAT PM RAFFLE will be electronically drawn, and he/she will be notified through the email address and/or mobile number provided upon registration in the Website. All winners are subject to the terms and conditions below:

   1. Eligible winners of a Grand Prize are required to submit a valid GIID within 72 hours upon notification even if they have previously submitted. This will be subject to verification by a PMFTC representative. If the winner fails to submit said ID and/or does not meet the eligibility requirements, he/she will be disqualified, and his/her prize will be deemed forfeited. Another winner will be drawn and undergo the same eligibility verification process.

   2. Reasonable efforts will be made to contact eligible winners prior to confirmation of win. Should eligible winners fail to submit a valid GIID within 72 hours upon notification, or do not meet any of the eligibility requirements or fails to comply with the Promotion’s terms and conditions, the winner will be disqualified and the prize/s will be deemed forfeited. PMFTC reserves the right to draw/select another winner who will undergo the same eligibility verification process.

   3. Verified winners in the monthly raffle draws will be published in PhilipMorris.ph.

   4. Once verified:

      1. Verified winners of the Grand Prizes have sixty (60) days from the end of the Promotion Period to claim his/her prize. If the prize remains unclaimed 60 (sixty) days after the end of the Promotion Period, it will be forfeited in favor of PMFTC.

      2. To claim a Grand Prize from THE GREAT PM RAFFLE, verified winners must present the email and/or SMS from PMFTC, and any two (2) valid GIIDs (acceptable valid Government Issued IDs as proof of age are: Passport, Alien Certificate of Registration, Driver’s License, Firearms License, NBI Clearance Card, Philhealth ID, Postal ID, PRC ID, SSS ID, TIN ID, Unified Multi-Purpose ID or Voter’s ID) that correspond to the profile information used upon registering on PhilipMorris.ph. If there is any discrepancy in the documents produced for verification and the registered profile, the winner will be disqualified, and the prizes deemed forfeited.

6. All Prizes are non-transferable nor convertible to other products.

7. Verified winners of a Grand Prize shall claim the prize at the nearest PMFTC Sales Office. Verified winners will have to coordinate with the PMFTC Authorized Third Party Agency for the schedule of the physical redemption of prizes. Walk-ins will not be entertained. Schedules for redemption will be subject to community quarantine guidelines issued by the national and/or local government units.

   1. Verified winners must claim their prizes personally. In cases where a winner cannot claim his/her prize personally, an authorized representative who is at least eighteen (18) years old can claim on behalf of the winner provided all the following documents are presented:

      • Valid GIID of representative for identity check and age verification;

      • Copy of a valid GIID of winner for identity check and age verification;

      • Signed authorization letter (not photocopy) stating that the winner is authorizing the representative to receive prize. The letter must contain the full name of the winner, full name of the representative and prize/s won. The authorization letter will be surrendered to PMFTC; and

      • Copy of PMFTC’s email/SMS notification to the winner.

8. In accordance with the Verified Member’s acceptance of the PMI Consumer Privacy Notice when participating in the Promotions, the winners agree to the inclusion of their names and/or photos in any advertising or publicity materials/activities in whatever format, within or outside www.PhilipMorris.ph, and including but not limited to posters, videos, or any other materials that PMFTC may produce.

9. Winners of THE GREAT PM RAFFLE are eligible to join and to win in THE GREAT PM INSTANT REWARDS.

II.C. MECHANICS: PHILIPMORRIS.PH THE GREAT PM INSTANT REWARDS

1. Only Verified Members who have submitted a valid GIID as proof of age (“GIID Verified Members”) may redeem prizes/rewards from THE GREAT PM INSTANT REWARDS in PhilipMorris.ph.

2. GIID Verified Members may use the coins they earned in PhilipMorris.ph to redeem a Giftaway voucher useable in select merchants listed in THE GREAT PM INSTANT REWARDS catalog:

   *All vouchers will be redeemed through Giftaway and are subject to availability and additional terms and conditions of Giftaway.

3. Upon redemption, each Giftaway voucher is valid only for the selected merchant.

4. PMFTC reserves the right to add/remove a merchant and increase/decrease the voucher value.

5. Each Verified Member may redeem only within the limits of each prize as stated in the list. Each merchant and denomination have a unique limit.

6. Any and all redemptions are considered final. GIID Verified Members may not exchange or return any Giftaway voucher.

7. GIID Verified Members will automatically be informed via PhilipMorris.ph if any item is out-of-stock. Any item out-of-stock will be unredeemable until PMFTC replenishes the stock of this item.

8. PMFTC reserves the right to modify or change the redemption cost of any item.

9. PMFTC may implement flash promotions and sales to change the redemption cost of any item. The special price will be applicable only during the period of the corresponding flash promotion or sales, subject to these terms and conditions.

10. GIID submission for age-verification is a requirement prior to redeeming any prize. Non-GIID Verified Members will not be able to use their coins to redeem any prize.

11. Upon GIID verified participant’s confirmation of claiming a prize, PhilipMorris.ph will trigger Giftaway.com to send the corresponding Giftaway eGift to the GIID verified participant’s registered mobile number.

12. Coins will only be deducted from the GIID Verified Member’s account once PhilipMorris.ph has confirmed that the prize has been sent.

    1. Should there be failure in sending the prize, the participant will automatically be informed via a notification on the Website. No coins will be deducted from his/her account for the failed redemption.

13. The prizes are non-transferable nor convertible to cash or other products. All Giftaway eGifts are subject to Giftaway and Giftaway participating merchants’ terms and conditions.

14. Upon participant’s receipt of corresponding Giftaway eGift/s, the prize is considered claimed. PMFTC is no longer liable for sent out Giftaway eGift/s. Use of the Giftaway eGift is subject to the terms and conditions of giftaway.com

15. If a GIID verified participant should report a lost or failure to receive a Giftaway eGift they have redeemed, PMFTC will conduct investigation to determine if the eGift has been used.

    1. PMFTC will only entertain requests to resend or replace a voucher if the initial eGift redeemed by the participant is still unused at the time of request.

    2. If PMFTC is able to determine via the Giftaway platform that the voucher has already been used, PMFTC is no longer liable to resend the eGift of the GIID verified participant.

16. By participating in THE GREAT PM INSTANT REWARDS, winners agree to the inclusion of their names and/or photos in any advertising or publicity materials/activities in whatever format, within or outside www.PhilipMorris.ph, and including but not limited to posters, videos, or any other materials that PMFTC may produce.

17. GIID Verified Members redeeming prizes from THE GREAT PM INSTANT REWARDS are eligible to join and win in THE GREAT PM RAFFLE and other promotions in PhilipMorris.ph.

II.D. MECHANICS: PHILIPMORRIS.PH TASKS

1. Apart from inputting valid Philip Morris unique pack codes, a Verified Member may earn coins by accomplishing specific tasks or activities specified in PhilipMorris.ph. Below is the list of tasks/activities that each Participant can do to earn coins:

2. Once the task/activity limit is reached, a Verified Member can no longer earn coins by accomplishing the same task/activity until task/activity is refreshed.

3. Monthly Task and/or Daily Log-in Bonus reward will not be automatically credited to Verified Member. Verified Member must claim their reward after completion of task by clicking “Claim Now” on their “My Profile Page.” Website will notify them through the Navigation Bar once they have completed a task. Failure to claim reward would lead to forfeiting of reward after Monthly Task and/or Daily Log-in Bonus has been refreshed.

4. Monthly tasks are refreshed every last day of the calendar month. Daily Log-in Bonus (Coin Toss) is refreshed every 12:00 midnight of the following day. Refresh periods are communicated on the “My Profile Page” of the Verified Member and may change from time to time as communicated on the same page.

III. OTHERS

1. PMFTC will verify the identity and age of the Participants. Participants who fail the eligibility verification shall be informed that they are not eligible to participate and/or win in the Promotions. Winning Participants who do not meet the eligibility requirements or fails to comply with the Promotions’ terms and conditions will be disqualified and their prizes will be deemed forfeited.

2. One or more Participants using the same mobile number or a Participant using multiple mobile numbers to participate in the Promotions will be disqualified. PMFTC reserves the right to hold, suspend, disqualify or block the Participant’s account or to terminate his/her participation in the Promotions due to suspicious activity, fraud or any irregular or illegal activity.

3. Participants agree and confirm the following:

   1. That you are a legal-age smoker, 18 years old or above as of May 7, 2021;

   2. that you have read and understood the terms & conditions detailed herein;

   3. that you agree to follow the applicable mechanics of the Promotions and of selecting the winners for it;

   4. that you agree to assume the risk of loss of or damage to property (collectively “property losses”), or illness or injury (collectively “injuries) that you may sustain in conjunction with your participation in the Promotions;

   5. that you agree to assume all such risks, foreseeable or otherwise, and hereby release and discharge PMFTC, its affiliates and all other persons and entities connected with the Promotions from any liability for, or any claims that may arise in respect of, any and all property losses and/or injuries whatsoever that you may sustain, no matter how any such property losses and/or injuries are caused.

4. PMFTC will only shoulder final withholding taxes on prizes amounting to more than P10,000 except as expressly provided herein. PMFTC will not be liable to the winners for any taxes, costs, liabilities or expenses that may arise out of ownership or use of the prizes.

5. Employees of PMFTC, its affiliates, distributors, advertising and promotions agencies or companies involved in the Promotions, their agents, as well as their respective relatives up to the 2nd degree of consanguinity or affinity are not eligible to join or win in the Promotions. Members of APPWARDS or participants of any existing sales or trade program of PMFTC are disqualified from participating and winning in the Promotions.

6. The validity of the Giftaway eGift, its use and redemption period are solely the discretion of the Giftaway’s participating merchants and not PMFTC. Furthermore, use of the Giftaway eGift and redemption period is subject to the terms and conditions of Giftaway and Giftaway’s participating merchants.

7. PMFTC reserves the right to substitute rewards (including supplier of such rewards) or make payments of at least equal or greater value due to, among others, events beyond PMFTC’s control. Circumstances arising outside our control mean that PMFTC is unable to provide such rewards through the method originally offered under the Promotions.

8. All decisions of PMFTC and its agents in all matters relating to the interpretation and implementation of the Promotions, as well as the selection of winners are final, and no objections and/or appeals thereon will be entertained.
